How Accidents with Scaffolding happen

Scaffolding can become extremely dangerous if it is not constructed properly.  It is important that an experienced and fully trained person erects scaffolding as incorrect construction is a common cause of scaffolding collapsing.  It is also important that all of the correct parts and components are used.  For instance if a damaged or unsuitable bolt is used, this is another common cause of collapse.

It is rare for an entire scaffolding construction to collapse but even if a small section collapses, a single floorboard flips or a safety rail moves it could have serious consequences for anyone nearby, particularly if they are working at height.

As mentioned in the section above there is always a risk of injury from falling objects when scaffolding is being used.  This is why it is important for workers on construction sites to be issued with the correct PPE (Personal Protective Equipment) including hard hats.

Laws to protect Scaffolding Workers

Legislation in place to protect people working with scaffolding

There are many different laws in place to protect workers from injury.  The 3 main pieces of legislation which apply to scaffolding workers are probably:

The Work at Height Regulations 2005
The Provision and Use of Work Equipment Regulations 1998 (PUWER)
The Personal Protective Equipment at Work Regulations 1992

The Work at Height Regulations 2005

The Work at Height Regulations apply to all work at height where there is a risk of a worker falling and suffering a personal injury.

The regulations state that employers and in fact anyone who controls the work of others such as site managers for example have to ensure all work at height is properly planned and organised, that those involved in working at height are competent, that the risks from working at height are assessed and appropriate work equipment is used, that the risks from fragile surfaces are properly controlled and equipment for work at height is properly inspected and maintained.

The Provision and Use of Work Equipment Regulations 1998 (PUWER)

In general the PUWER regulations state that workers must be supplied with equipment which is in a safe condition to use and suitable for the job in hand. They also state that work equipment should only be given to those people who are trained to use it and that the equipment should be accompanied by appropriate Personal Protective Equipment (PPE).

The Personal Protective Equipment at Work Regulations 1992

The main point of the PPE regulations is to ensure that workers are supplied with suitable PPE whenever they are exposed to a risk of injury at work which can't be avoided by doing things differently.

The regulations also state that the equipment should be properly assessed before use to ensure it is suitable, is maintained and stored properly, is provided with instructions on how to use it safely and is used correctly by employees.
