Introduction to Personal Injury Claims for Cleaners

About Compensation Claims for Cleaners and Domestics

As a cleaner or domestic you can face many dangers each day as part of your job.  Every employer has a duty to protect their employees whilst at work and to eliminate or minimise the risk of any injuries occurring.

If you are injured at work as a cleaner or domestic and the accident was not your fault, you may be able to make a personal injury claim for compensation.  If you are a trade union member, you should contact your union in the first instance.  If you are not a trade union member, contact Thompsons on 08000 224 224 or complete one of our online personal injury compensation claim forms.

Risks of Injury to Cleaners and Domestics

Common hazards faced by Cleaners and Domestics

Below, you will find just a few examples of how cleaners and domestics come to be injured at work.  We can, however, help people who have been injured in other ways and to discuss your individual case, you can reach us on 08000 224 224 or complete one of our online personal injury compensation claim forms.

Cleaning Products and Chemicals

Cleaners and Domestics normally work with cleaning products containing chemicals, some of which can be harmful if used incorrectly.  There are detailed regulations in place which are designed to protect all workers from exposure to chemicals and other substances in the workplace and these are called “The Control of Substances Hazardous to Health Regulations” (COSHH).

The COSHH regulations state that employers must first try to avoid using any chemicals known to be hazardous and replace them with safe alternatives.  If this is impossible, they must minimise the exposure and provide appropriate Personal Protective Equipment (PPE). For a cleaner or domestic, this may include gloves, boots, overalls or goggles.

Dangerous chemicals can cause problems with the skin such as dermatitis or breathing problems such as asthma.

Needlestick Injuries

In the past at Thompsons, we have dealt with claims for cleaners and domestics who have unfortunately suffered needlestick injuries.  The incidents have normally happened because objects such as syringes or scalpels (known as sharps) have not been disposed of correctly into a sharps bin.  If they are put into a normal refuse sack, they can protrude through the thin plastic and penetrate the skin of someone lifting or moving the sack.

We have also helped clients who have suffered a needlestick injury whilst cleaning areas such as public toilets, gardens and parks or stairwells where syringes have been discarded.

Manual handling Injuries

The Manual Handling Operations Regulations 1992 (amended in 2002) are designed to protect employees from injuries caused by Manual Handling at work. Contrary to popular belief manual handling is not just lifting and carrying but also lowering, pushing and pulling.

As a cleaner or domestic, you may have to move equipment such as large vacuum cleaners, floor polishers etc.  You may also have to move furniture or other objects to clean beneath them.

The regulations state that employers should eliminate any manual handling which is not absolutely necessary, carry out a risk assessment of all of the manual handling which cannot be eliminated and which may cause an injury and to try to reduce the risk of injury from all essential manual handling as much as possible.  This includes providing appropriate training on how to lift safely.

Asbestos Related Illnesses

As asbestos claim specialists, Thompsons have dealt with many cases in the past for people who worked as cleaners decades ago, who have gone on to develop an asbestos related disease.

When asbestos sheets or lagging become damaged they tend to create a dust which cleaners were often asked to sweep up.  This dust contained dangerous asbestos particles and years later caused debilitating and sometimes fatal health conditions to develop.
