Medical Misdiagnosis
In this case, our client was admitted to hospital with abdominal pain. He was misdiagnosed and was given unnecessary surgery as a result of the misdiagnosis. The wound became infected and our client had to undergo a second surgery to clean out and repair the original surgical wound.
Liability was admitted by the hospital but Kashmir needed to issue court proceedings to recover a fair amount of damages for the client which included a payment for lost earnings.
Negligence during Childbirth
Our client was in labour with her first child when the medical team failed to notice that her unborn baby was in distress. The baby was distressed for several hours before a decision was eventually made to deliver by Caesarean Section. Unfortunately by the time this was done it was too late and the baby sadly died a few days later in the special care baby unit. The baby had suffered massive brain damage as a result of the mismanaged birth.
No amount of money could ever compensate our client for the loss of her first baby but Kashmir dealt with the personal injury claim in a very sensitive manner and recovered compensation for the client.
Cerebral Palsy Compensation
In this case, our client had suffered birth asphyxia while his mother was in labour which resulted in a severe brain injury. He was diagnosed with cerebral palsy but his family did not make a claim for compensation immediately.
When they did decide to make a personal injury claim, they were incorrectly advised by another solicitor that they could not claim as their son was more than 3 years old. The family cared for him for over ten years before Kashmir heard of the case and started work on it for them.
The hospital admitted liability and Kashmir settled the claim for almost £4m without it going to court. Our client is now a young man and is totally dependant on others. He can't walk unaided, can't talk and has severe leaning difficulties. The compensation secured his long-term future and enabled him to have the opportunity to develop to his full potential and make his life as happy and fulfilled as possible. It also enabled the family to buy a larger house which could be adapted to his needs.
