Successful Clinical Negligence Claims

Below you will find just a small selection of some of the successful clinical negligence claims Anne has dealt with from the Bristol office.

Misdiagnosed Retinal Detachment

Anne's client in this case was a man in his 30's who started suffering from problems with his eyesight.  Over a period of two years he paid several visits to his GP and his optician before being referred to a specialist.  Various reasons for his sight problems were given until he was referred to a Consultant Ophthalmologist and was eventually diagnosed as having a detached retina in several places.

He underwent two operations which prevented his sight from deteriorating further but the damage which had been done over the course of the two years could not be reversed. He was left almost blind and unable to read or watch TV.  He even experiences difficulties recognising people.

Anne successfully made a claim for medical negligence compensation against both his optician and the specialists at the hospital who had all failed to correctly diagnose the condition and allowed his sight to deteriorate.

Skin Cancer Misdiagnosis

In this case Anne acted for the widow of a man who tragically died after his skin cancer was misdiagnosed as a benign lesion.  The man had visited his GP quite a few times with concerns about a mole he had before the GP eventually removed it.  Without sending the mole to be analysed by the histology department, the GP diagnosed it as a harmless benign lesion.

Several months later it was discovered that the mole had been a malignant melanoma (cancerous) all along and that it had spread and become a terminal cancer.  The man died just a few months later.

Anne made a claim for medical negligence compensation arguing that the man should either have been referred to hospital to have the mole removed or if his GP removed the mole, it should have been sent for testing afterwards.  In both cases this would have meant that the cancer would have been detected at an earlier stage and the man would have survived.

Anne was successful in recovering compensation for the widow which provided some financial security for the man's family.  Some of the compensation was invested in a Trust Fund for his children.

Fatal Head Injury

Anne's clients in this case were the family of an elderly lady who died after suffering a serious head injury and never regaining consciousness.

The lady was being treated in a mental health unit and had been deemed to need one-to-one care, never being left on her own. Unfortunately she was left unsupervised for a period of time and was later found with her injuries.

The Trust responsible for her care initially denied liability for her injuries and subsequent death but after an inquest was carried out which deemed the hospital to have failed the lady they admitted liability and compensation was secured for her family.
