Error made during surgery
Our client fell off his bicycle and was taken to A&E. An Xray showed a fracture to the right humerous and he underwent surgery which involved the use of an intra-medullary Biomet nail.
Following surgery our client noted that he could not lift or move his right wrist and had no sensation in the first web space. In fact his radial nerve had been severed and our client required a tendon transfer to stabilise his wrist.
Our expert evidence was that the nerve appeared to have been divided and damaged when the drill was locking the nail into position.
Fortunately our client was able to continue with his job but he is now permanently unfit to carry out jobs involving significant lifting.
Liability was admitted at an early stage and the case settled for £45,000.
