Unnecessary Amputation

Infection left untreated lead to amputation

Our client was admitted for a lateral patella release of the left knee. Following this surgery he developed a haematoma / infection which was allowed to go untreated with the result that a necrosis developed and finally, our client had to undergo an above the knee amputation.

Immediately following surgery, our client was in considerable pain and prescribed a large amount of morphine. It was only when he was eventually seen by a Plastic Surgery Consultant that the need to debride and wash the wound was identified. The haematoma was drained but by then necrosis had set in. The wound was washed and debrided and the amputation above knee eventually was made.

Eventually after lengthy rehabilitation following the surgery our client regained some mobility with the use of a prosthetic leg and crutches. He underwent further surgery to his left leg to neaten the stump and make it receptive to a flowerpot suction pad of his prosthesis.

The amputation compelled our client to give up his allotment and his hobbies of caravanning and hill walking are now much more restricted. Also, he is now unable to undertake much of his own DIY .

Breach of duty and causation were admitted at an early stage in the case and following the disclosure of an occupational therapy report and a prosthetics report, the first offer at £250,000 was made which was subsequently increased to £270,000 until a final offer of £292,500 was accepted in settlement following service of the Defence.

A significant part of our client’s damages was provided to fund the purchase of a new C-Leg Prosthesis.
